Johannes "John" Rodenberger's Will

When I was in Brazil, Indiana visiting the Clay Co. Courthouse in 2010, I transcribed Johannes "John" Rodenberger's will dated 10 May 1869.  It was recorded on 31 October 1870, several days after John's death on 22 Oct 1870.

Johannes, at birth, John by 1820 in Ohio, was my 5th great-grandfather.  I have made several posts regarding him:  Dec. 11, 2011 his obituary; Sept. 20, 2011 his burial site; and Aug 28, 2013 when I found the burial location of his first wife Elizabeth.

In the name of God Amen.  I John Rodenberger of Clay County Indiana a being in good bodify health and of sound mind and memory calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs and directing how the estate with which it has pleased God to blefs me shall be disposed of after my decease while I have strength and capacity So to do, do make and publish this my last will and testament hereby revoking and making null and void all other wills and testaments by me heretofore made.

                First – I hereby constitute and appoint my wife Catharine Rodenbarger to be sole executrix of this my last will and testament and direct her to pay all my just debts and my funeral expenses out of my personal estate as soon after my death as she conveniently can.

                Second.  It is my will that without any inventory appraisement or sale of my real or personal estate and without letters of execution or other liability or accountability to any party or parties whomsoever except as above directed that my said wife Catharine Rodenbarger have all the personal property of which I may die profsefsed for her own, free from any and all claims and control and that she have without responsibility for waste for and during her natural life all the real estate of which I may die seized with full power to use the same in all respects as fully and as free from liability as though the free [    ] thereof were vested in her she to pay taxes and keep the fences in repair.

                Third.  It is my will that at the death of my said wife Catharine all the real estate of which I may die seized be sold and the proceeds thereof after paying the expenses of said sale be divided in equal shares between the children of said Catharine my wife my her first and second marriage including William and Henry Schromyer and my children by my first and second marriages counting the children of such said children as are dead or may die here after as one child.

                In Witnefs where I have herewith set my hand and seal this 10” day of May AD 1869.

                Be it Remembered that on the 31” day of October 1870 August H Christman one of the subscribing witnefses to the within and foregoing last will and testament of John Rodenbarger late of said county deceased personally appeared before Charles H Knight clerk of the Court of Common Pleas of Clay County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows that is to say:  That on the 10” day of May AD 1869 he saw the said John Rodenbarger sign his name to said instrument in writing as and for his last will and testament and that this deponent at the same time heard the said John Rodenbarger declare the said instrument in writing to be his last will and testament and that said instrument in writing was at the same time at the request of the said John Rodenbarger and with his consent attested and subscribed by the said August H Christman and Benjamin Elkin in the presence of said Testator and in the presence of each other as subscribing witnefs thereto and that the said John Rodenbarger was at the time of signing and subscribing of the said instrument in writing as aforesaid of full age (that is more than twenty one years of age) and of sound disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not

County of Clay SS              I, Catharine Rodenberger widow of the within named John Rodenberger, deceased, knowing the contents and the provisions of the within and forgoing last will and testament of my said husband, now deceased, do hereby declare that I have, and do forever release and relinquish, waive and disaffirm my right, estate and interest in the estate and property of my said husband as given me by the statute and laws of said State, and do hereby fully and completely accept and confirm, and have accepted and confirmed the bequests and desires made to me by said Will:  The forgoing ratification shall be retroactive to the date of the probating of said will.  Witness my hand and seal hereto this the 9lt day of October A.D. 1871.                                                                Cathareine (her mark) Rodenberger *Seal

Sunday's Obituary - John W. Rodenberg, John W. Rodenberger



A Sudden Death

Yesterday John Rodenberg, who lives at No. 930 north F street, and who has for a long time been an invalid, had two attacks of vertigo, one of them was so severe that he fell with it. Last evening he repaired to his room. About 2 o'clock his granddaughter, Cora Baker, on going up stairs to retire, looked into his room and saw that his chin was resting on the bed and his feet and body on the floor. She approached him and found that he was dead. A newspaper was lying on the chair and he had his spectacles on, showing that he had been reading. He probably arose from his chair and started to the bed and fell before reaching it. Coroner Zimmerman was summoned and found that he had died from a stroke of apoplexy. He would have been seventy-three years old if he had lived till next New Year's day. His wife, who was in Chicago on a visit at the time, has been telegraphed for, and also other relatives who live at a distance. The time for the funeral will be arranged as soon as they arrive

Both newspapers are from Richmond, Wayne Co., Indiana.  Copies received from Morrison-Reeves Public Library, Richmond, Indiana.

John W. Rodenberger, son of Johannes [John] and Elizabeth Rodenberger, was born January 1, 1818 in Ohio, possibly Montgomery Co.  His first wife was Anna Maria Plankenhorn. They had at least four children.  She died in 1847.  John married Maria Long on April 23, 1848.  They had seven children.  John and his second wife are buried at Earlham Cemetery in Richmond, Wayne Co., Indiana. 

John and his brother George shortened their name from Rodenberger to Rodenberg.

Other Rodenberger Relatives in Philomath Cemetery

My previous post was about Elizabeth Rodenberger's grave at Philomath Cemetery in Union Co., Indiana.  Other family members are buried there as well.

Rachel Reasar.  October 9, 1813 - July 28, 1893.
     Rachel was the third child of Johannes "John" and Elizabeth Rodenberger.  She was born in Upper Milford Twp., Northampton Co, Pennsylvania.  She was baptized at Upper Milford Reformed Congregation on November 25, 1813 with Peter and Christine Hertzell as her sponsors .

Daniel Reasar.  Died September 20, 1857.  Aged 45 years, 4 months, 2 days.
     Rachel Rodenberger and Daniel were married February 25, 1834 in Wayne Co., Indiana

Elizabeth Reasar.  Daughter of D. and R. Reasar.  Died September 12, 1857.  Aged 18y, 8 m, 9d.
     Father and daughter died 8 days apart.

Ann M. Rodenberger, wife of John R. Rodenberger. Died February 19, 1847.  Aged 26y, 3m, 15d.
     Anna Maria Plankenhorn was the first wife of Johannes and Elizabeth's son John W. Rodenberger.  John, at some later date, shortened his surname to Rodenberg.  Both of Ann Maria's parents and possibly a brother are also buried at Philomath Cemetery.

Martin D. Rodenberger, son of John and Maria Rodenberger.  Died March 28, 1849.  Age 2 years.
     It is likely that his mother died at or near his birth.

Alvin Rodenberger, son of John W. and Maria Rodenberger. Died June 21, 1857. Aged 1yr, 21 days.
     Son of John W. and his second wife, Mariah Long Rodenberger.

Sarah Stanfer. Wife of Henry Stanfer.  Died September 12, 1853. Aged 20 yrs, 7 mo, 16dys.
     Sarah was the daughter of Johannes and Elizabeth Rodenberger.  Possibly child #10.  I believe her last name was actually Staufer based on Henry Staufer's 1907 obituary:
                  "In the year of 1850 he was married to Sarah Rodenbargar, and to them were born two       children, Helena McCashland, who lives near Abington, and the other dying in infancy at the time of its mother."

Phebe J. Rodenberger. Daughter of George and C. Rodenberger.  Died May 1, 1862.  Aged 11years 10months 3days.        George was the son born after John W. Rodenberger.  Both young men married Plankenhorn
sisters.   Phebe was one of 13 children and the only one not to reach adulthood.

Sunday's Obituary - Johannes "John" Rodenberger

While visiting the Clay Co. Genealogy Society in Center Point, Indiana, I found the following abstract in the Rodenbarger Family File.

   d. John Rodenbarger, at res, Wash. Twp, Sat. Oct 22, 1870, 86 yrs.  res of twp for more than 25 yrs.  Member German Reform Church. father of 19 ch., step-father of 2 ch.

Johannes was born on 22 July 1785 in Pennsylvania.  His parents were Johann Georg  and Elisabeth (unknown) Rothenberger.  Johannes married Elisabeth prior to 1809 when their son Samuel was born.  Johannes and Elisabeth's first three children (Samuel, Leah, and Rachel) were born in Upper Milford Twp, Northampton Co, Pennsylvania. 

In March of 1829, the Rodenberger family was living near Montgomery Co, Ohio.  In July 1832, Johannes purchased land in Wayne Co, Indiana and sold the property in December 1846.  He purchased land in Clay Co., Indiana in January 1846.  

I believe Elisabeth died while the family was living in Wayne Co, Indiana after the 1840 Federal Census. Johannes married Catharine (March) Schromyer, a widow with two children, between 1842 and 1844.

Genealogical Coincidences

It has happened twice this month!  I'm entering data on Find A Grave and decide to search the cemetery's memorials.  A name from my family tree has recently been entered - Elizabeth Digby Dawson.  I did not have a death date nor burial location for Elizabeth.  I began to link some of her children's memorials to Elizabeth's memorial.  I found someone had posted photographs of the individuals on their memorials.  I emailed the contributor and find out that she is a daughter that I didn't know about and we are "cousins" . . . AND she is interested in genealogy.  Both of us have summer travel plans, but hope to share our information soon.

The second time occurred last night.  I had found a book published in 1930 that listed some family names, death dates, and burial locations.  After updating my database, I entered the information on Find A Grave.  I searched, by last name, the site verifying that a memorial had not already been established for one individual at Earlham Cemetery, Richmond, Wayne Co, Indiana and found that his father's memorial had been entered that day.  The same day that I'm entering his children's memorials!  Now I was able to link together more family members.

I just love when some of the puzzle pieces click together so easily!  Don't you?
