Johannes "John" Rodenberger's Will

When I was in Brazil, Indiana visiting the Clay Co. Courthouse in 2010, I transcribed Johannes "John" Rodenberger's will dated 10 May 1869.  It was recorded on 31 October 1870, several days after John's death on 22 Oct 1870.

Johannes, at birth, John by 1820 in Ohio, was my 5th great-grandfather.  I have made several posts regarding him:  Dec. 11, 2011 his obituary; Sept. 20, 2011 his burial site; and Aug 28, 2013 when I found the burial location of his first wife Elizabeth.

In the name of God Amen.  I John Rodenberger of Clay County Indiana a being in good bodify health and of sound mind and memory calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs and directing how the estate with which it has pleased God to blefs me shall be disposed of after my decease while I have strength and capacity So to do, do make and publish this my last will and testament hereby revoking and making null and void all other wills and testaments by me heretofore made.

                First – I hereby constitute and appoint my wife Catharine Rodenbarger to be sole executrix of this my last will and testament and direct her to pay all my just debts and my funeral expenses out of my personal estate as soon after my death as she conveniently can.

                Second.  It is my will that without any inventory appraisement or sale of my real or personal estate and without letters of execution or other liability or accountability to any party or parties whomsoever except as above directed that my said wife Catharine Rodenbarger have all the personal property of which I may die profsefsed for her own, free from any and all claims and control and that she have without responsibility for waste for and during her natural life all the real estate of which I may die seized with full power to use the same in all respects as fully and as free from liability as though the free [    ] thereof were vested in her she to pay taxes and keep the fences in repair.

                Third.  It is my will that at the death of my said wife Catharine all the real estate of which I may die seized be sold and the proceeds thereof after paying the expenses of said sale be divided in equal shares between the children of said Catharine my wife my her first and second marriage including William and Henry Schromyer and my children by my first and second marriages counting the children of such said children as are dead or may die here after as one child.

                In Witnefs where I have herewith set my hand and seal this 10” day of May AD 1869.

                Be it Remembered that on the 31” day of October 1870 August H Christman one of the subscribing witnefses to the within and foregoing last will and testament of John Rodenbarger late of said county deceased personally appeared before Charles H Knight clerk of the Court of Common Pleas of Clay County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows that is to say:  That on the 10” day of May AD 1869 he saw the said John Rodenbarger sign his name to said instrument in writing as and for his last will and testament and that this deponent at the same time heard the said John Rodenbarger declare the said instrument in writing to be his last will and testament and that said instrument in writing was at the same time at the request of the said John Rodenbarger and with his consent attested and subscribed by the said August H Christman and Benjamin Elkin in the presence of said Testator and in the presence of each other as subscribing witnefs thereto and that the said John Rodenbarger was at the time of signing and subscribing of the said instrument in writing as aforesaid of full age (that is more than twenty one years of age) and of sound disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not

County of Clay SS              I, Catharine Rodenberger widow of the within named John Rodenberger, deceased, knowing the contents and the provisions of the within and forgoing last will and testament of my said husband, now deceased, do hereby declare that I have, and do forever release and relinquish, waive and disaffirm my right, estate and interest in the estate and property of my said husband as given me by the statute and laws of said State, and do hereby fully and completely accept and confirm, and have accepted and confirmed the bequests and desires made to me by said Will:  The forgoing ratification shall be retroactive to the date of the probating of said will.  Witness my hand and seal hereto this the 9lt day of October A.D. 1871.                                                                Cathareine (her mark) Rodenberger *Seal

Marriage of James Taylor and Leah Rinehart

While researching in Dayton, Ohio last June, I photographed the marriage record for James Taylor and Leah Rinehart.  At the Montgomery County Records Center in the Reibold Bldg., the records were removed from the bound record books and encased in archival protectors.

James and Leah were married 27 January 1822 in Montgomery County, Ohio.  Many family trees have an erroneous date of 1828.

James Taylor was born 23 April 1797 in Orange Co., Virginia. I have seen James' father listed as both Francis and John Taylor.

Leah Rinehart was born 23 Dec. 1793 in Botetourt Co., Virginia.  Her father was John Rinehart.  Most descendants report that her mother was Barbara Warren, but Mary Lossing questioned that belief in 1971.  Mary found a Deed from Botetourt Co, Virginia that was signed in 1793 by John Rynhart and Barbara Nuesfal. 


 

Married on the 27 day January last James Taylor and Leah Rhinehart.

Elizabeth Rodenberger - Found at Last!

On my trip yesterday to the DAR Library in Washington, DC, I discovered the burial location for my 5th great-grandmother!  From the Cemeteries of Union County, Indiana book, Elizabeth Rodenberger, wife of John Rodenberger, died on September 30, 1842 at the age of 51 years, 11 months, 30 days.  She is buried in  Philomath Cemetery in Brownsville Twp, Union Co., Indiana.

Elizabeth's calculated birthdate would be October 1, 1790.  Her first child, Samuel Rodenberger, my 4th great-grandfather, was born to her at age 18 (thanks, Ray for the calculations). 

Elizabeth and John (Johannes) had at least 10 children:  Samuel, Leah, Rachel, Elizabeth, John W, George, Jacob, Paul, Peter, and Sarah.  Samuel, Leah, and Rachel were born and baptized in Upper Milford Twp, Northampton Co, Pennsylvania.  After Elizabeth's Pennsylvania birth, the family arrived in Ohio before 1818.  John Rodeberger was enumerated in the 1820 Federal Census of Montgomery Co, Ohio. In 1832, John purchased land in Wayne Co, Indiana, an adjoining county to Union Co.

Elizabeth is still a mystery since I don't know her maiden name or who her parents were.

A side note on the value of cemetery surveys.  The book mentioned above that contained this vital information was compiled in 1934 [Lacks title page, title information from 4th leaf - from the DAR Library catalog].  Based on the photo of the cemetery on the Find A Grave website, I'm fairly certain that these gravestones would be unreadable today.

This cemetery is located off of C. Rodenburg Rd. on the south end of Philomath. The condition is severely neglected. At one time, there used to be a church close by the cemetery but all that is left is the foundation.

Sunday's Obituary - Johannes "John" Rodenberger

While visiting the Clay Co. Genealogy Society in Center Point, Indiana, I found the following abstract in the Rodenbarger Family File.

Dem. Archives, Oct. 27, 1870
   d. John Rodenbarger, at res, Wash. Twp, Sat. Oct 22, 1870, 86 yrs.  res of twp for more than 25 yrs.  Member German Reform Church. father of 19 ch., step-father of 2 ch.

Johannes was born on 22 July 1785 in Pennsylvania.  His parents were Johann Georg  and Elisabeth (unknown) Rothenberger.  Johannes married Elisabeth prior to 1809 when their son Samuel was born.  Johannes and Elisabeth's first three children (Samuel, Leah, and Rachel) were born in Upper Milford Twp, Northampton Co, Pennsylvania. 

In March of 1829, the Rodenberger family was living near Montgomery Co, Ohio.  In July 1832, Johannes purchased land in Wayne Co, Indiana and sold the property in December 1846.  He purchased land in Clay Co., Indiana in January 1846.  

I believe Elisabeth died while the family was living in Wayne Co, Indiana after the 1840 Federal Census. Johannes married Catharine (March) Schromyer, a widow with two children, between 1842 and 1844.

Susannah (Dice) Rodenberger Anderson

I mentioned Susannah's obituary in yesterday's post.  On a research trip to Vigo and Clay Co, IN, I visited the Indiana State Archives in Indianapolis.  I didn't allow for enough time (only had two hours before my flight), but found one of my main goals - Susannah's obituary on microfilm of the Democrat, Brazil, IN on Feb. 2, 1888.


"Died, at her home, at this place, Sunday night last, of general debility, Mrs. Susanna Anderson, aged 80 years 4 months and twenty days; funeral services, Tuesday at 10 o'clock, conducted by Rev. T. Calvin Stewart.  The deceased was a native of Canada, born near Lundy's Lane, 1807.  She was the mother of Moses Rodenberger of this city, and aunt to F. W. Schromyer."

My cousin, and fellow Rodenberger/Dice/Spring/Moreland researcher, Ray found Susannah and Samuel Rodenberger's marriage record on microfilm from the Family History Library - marriage records of Montgomery Co, Ohio. The recording is the last on the page "20th of March 1829"

Starting Out

This is my first post.  I am both a quilter and genealogist; although, the genealogy part has been my main focus for the past several years.  Both avocations are similar:  taking pieces and putting together the whole.

Last week I happened upon a book at my local library's genealogy section:  Early Ohio Tax Records compiled by Esther Weygandt Powell.  I searched the index looking for my family's surnames and found a familiar name:  Peter Dice. 

Peter has been most elusive prior to his daughter's wedding on 20 March 1829 in Montgomery Co, OH where Susannah Dice married Samuel Rodenberger.  From the various U.S. Censuses, Peter Dice was born in Pennsylvania around 1766.  Through Susannah (Dice) Rodenberger Anderson's obituary, Peter lived in Lundy's Lane, Canada in 1807.

In the Early Ohio Tax Records, Peter Dice was included in the list:  "1822 and 1823 Taxes Unpaid, Feb. 23, 1825" in Richland Co, Ohio.  Now I have a new area to focus my search for more information on Peter - who was his wife?  did Susannah have siblings?  who were Peter's parents? 

Such an exciting find when I didn't plan on researching my tree!
